Hi everyone,
I got my labor approved under perm on Sept 11th however I have not filed for I140 as yet. This is because of employer making n reasons to file the same. Anyways, if the 45 day rule comes into play - does my labor get cancelled as it has been more than 45 days since it has been approved or does the 45 day period start after April 26th. How many of you think this rule will come out. I hope it does. That way employers will have no choice but to file I 140. A lot of employers now adays are stalling filing the same since they fear the employee will move. Am I the only one facing the same problem or are there others as well?

In year 1999, AnnaLee Saxenian of Public Policy Institute of California did a study on immigrant engineers and scientists in Silicon Valley and the effect they had on California's economy. She contended that foreign-born engineers in Silicon Valley�s technology industry made a substantial and growing
contribution to regional job and wealth creation.

Today, a new study titled "Silicon Valley's New Immigrant Entrepreneurs", by researchers in the master of engineering management programme at the Pratt School of Engineering at the Duke University was released.
The study covered 28,766 firms with annual sales of more than USD 1 million and 20 or more employees. The lead researcher Vivek Wadhwa, contends that "this study shows the tremendous contribution immigrants in general and Indians in particular are making to the US economy and global competitiveness. This is a win-win for America and for the immigrants that make it here."

Both the above reports go towards re-inforcing our arguments. Core members may want to retain copies of these reports some place. Salient points of these two reports should be used in some of the presentation material we prepare.

I am assuming your wife is H4? H4 to F1 shouldnt be a problem, this is the same path I took years ago before becoming H1.
There is only one issue I can think of and that is travelling outside the country. She might not be issued an F1 visa stamp at a consulate for travel outside the country since her H4 was based on yours which now has immigrant intent since you applied for PERM (LCA and I-140). The consulate will probably not believe she has non-immigrant intent. She would have to stay in the country until she changed to H1 and got that stamped, or until you get AP for both of you. But if you have no plans to leave the country I dont see that as an issue. Best to consult a proper immigration attorney since all I can tell you is my experience.

Hi,
My H1 B is valid until 2010 (mar). But considering my entry/exit (I94) dates - I will be completing my 5 years in next 2 months.
My query:
1. Do I have time until 2009 (mar) for filing the Labor?
2. Can I file GC in the 6th year of H1 B, if yes what are the consequences?

Yes you ahve time. But don't wait hurry up, we need not get surprised if they change rules even....
Any way for March 2009 you have only 6 months you have so much work to do like paper adds, etc... so... All the best
