i think u will be covered under the new NC>180 policy so u can also send a demand letter through your lawyer after March 10, 08 (i am inferring this from updated FAQs for NC>180: pls see that FAQ for more info).

In my opinion, one of the more intriguing product announcements from Nikon today was the Coolpix 8700. If it improves significantly from the Sony, that could be a killer product. Right now, Canon is lacking a bit in the true consumer DSLR market. But then again, PMA is right around the corner. The Sony has Zeiss glass and 28mm WA. But the CA and Noise are horrible. Isn't the Nikon 8700 has same sensor size as the Sony 828? Wait and see how the Nikon performs in those deaprtments!

Rest all states should pass similiar law............
Is it for the strategy of getting all our members to take this law seriously when they are stopped by the cops and asked for papers? Unless something personally affects our members we are content in letting things happen around us........so if such laws were passed in many other states, it would definitely jolt us to action!!!!!!

You can apply for an MTR, and if it is approved, you are safe. If not, you will be out of status from the day your petition was denied.
You can apply for H1 with another employer and have it premium processed.

Nice textures but I don't quite like the left side... I think those yellow lines would maybe make a nice diagonal, starting from the upper left and then splitting either side of the lower right corner.
EDIT: Hope you don't mind, had to make a quick test, a little like this, but I'd like more of the yellow line at the upper left...

Chances of F1 denial is very high, if you apply from Mexico or Canada since it is going to be first F1. If at all you want to apply F1 outside USA, it is advisible to try at home consulate - still you will have to convince the IO that you do not intend to immigrate (which you may not be able to do it as your spouse is already here). Both options, in my opinion, big NO NO

If they are staying on a resident or employment visa in UAE they have to apply at the US Embassy in Dubai. If they are on a visit visa in UAE, they have to apply at the appropriate US Consulate in India.

I went for H1B stamping, but i know a friend of mine went for F1 (PhD) extension and had to go through the same process. I called Dept. of State multiple times, dont expect a polite response. They may even say it may take years. Thats what they told me the day before i got the visa. Dont worry your wife will get the visa eventually. Tell her to enjoy India in the mean time like i did on my forced vacation.

There are two ways of porting older priority date
#1 if your old PD is stuck in backlog center, file a new perm labor with exact same wordings( same category too ), this is well documented.
#2 If you have an approved labor(can be substituted also) and approved I-140, then file a new labor with any employer under any category(eb2 in your case). Once labor is approved, at the time of filling new I-140, you need to specify that you want to port priority date of previously approved I-140. Specify relavent memos too, try finding attorney who knows or have done this atleast once :D
"EB3 - Labor filed - Aug, 2004 - BackLogged - Philadelphia - 45 day letter - Replied"
priority date from above labor can only be captured if it gets approved and employer files and get I-140 approval for this labor, and then you go ahead and file a new I-140 for your already approved EB2 specifying need to recapture old PD.
This is all from top of my head w/o having any degree in relavent field, please talk to attorney before taking any action blah blah blah.......

I am a july 07 filer with EB2 PD Oct 2005. I switched employers in early part of this year. My employer has been very erratic and not paying me salary for past 2 months because his money is not cleared from his client. I have found another contract but my employer wants to wait until his money is cleared before he can pay me and that can take longer than 6 months !!! (if his money is not cleared before)
Under such circumstances I am jeopardising everything. I was wondering if I start working for my own company on a W2 with a same job profile same salary structure will USCIS consider this as something fraudulent or do they allow self employment under AC21 ? After I have my GC I plan to continue working for my own company. In that case what do I need to do from my side to make this happen ? I started my company in August 2008.
