I thought I did have a good lawyer! We have been with our current lawyer for the past 7 years. Currently, as I am out of the country, and not able to get back, due to the approval, I am at my wits end as to what to do.

Does anyone know of anyone in a similar situation, or heard about what one can do??

Would going to Canada and re-entering without going for visa stamping count as lawful entry??

Or one has to go and get the visa stamped to qualify as lawful entry??

Also when you go to Canada and come back Without VISA stamping, he gets the same I-94 or different I-94??

You can re-enter from Canada with same I-94 and status as long as trip < 30 days.

Yes, it resets out of status clock.

You can find out by calling USCIS. There is thread here teaching tricks to get to talk to a immigration/field officer. If you can do that, you can ask him/her, and may get the answer.

By saying they wouldn't adjudicate your case becase its PD is not current, I meant they wouldn't approve your case. But they will look at your case. If something is wrong, they'll correct it or send you a RFE, both of which will result in updates. If everything is all right but only your PD is not current, they will "put in suspense" your case, which will result in an update too, and send your case to some on hold shelf. When your PD is current, they'll approve your case.

Dear all,
My employer filed H1B with extension of stay even though I was not physically present in USA on the day of filing.I was out of USA on June 15th due to personal reasons and they filed H1B on July 10th.

I had requested them not to file extension of stay since I was already out of USA.USCIS approved the petition with extension of stay(I-94 attached).I need to go for visa stamping now .Will this create any issues while stamping?

Please advice.

Hi,

I applied for EAD Renewal on DEC-18 2009 ( posted to Nebraska Service Center)
It has been a month I havent received any Receipt or RFE and check for fee has not been cashed

My EAD will expire on March-15th-2010


What to do in this sitiuation?

Is there any customere service No to reach ?

Do i need to reapply ? Did anybody encounter similar situation. If so please let me know what you have done

Hello, I need your advice here. I have an old LCA, priority date 03/2003 that was stuck in the backlog center untill last week. Also, I applied through PERM for a new LCA that was approved and was able file I485 in July this year, just got the receipt numbers.

The new LCA has the priority date 04/2006 and is for an upgraded position. I heard that I might "interfile" and be able use the old priority date with the already submitted I485. Would you guys have any suggestions about it?. Any information that might help me?. Hopefully somebody outhere can help.

Starting April 1st, only two Service Center are responsible for all the I-140's, Nebraska & Texas. All I-140's are filed with Nebraska Service Center. Nebraska keeps some of the petitoins and transfers the others to Texas. The ones that NSC keeps has a receipt number starting with LIN whereas the ones that are transfered to TX has the receipt number starting with SRC. So even though the petition might be filed with NSC, chances are it might be approved sonner if it goes to TXSC. Nebraska is taking 4-5 months to approve a petition whereas TX approves it in 15-25 days.

I forgot that. they Do not need new I-94 every time. But I remember We were asked to put all Entry to Canada on I485 papers . I use to go Toranto Every week at that time.
