The Center for American Progress released a report detailing the actual cost of the only solution proposed by anti-immigration restrictionists--Mass Deportation. One, bring 12 million people out of the shadow economy and into the light. Allow them to pay taxes. Allow them to drive without fear. Allow them to live with their families. Allow them to generate wealth in the greatest economic engine ever created by man, the U.S. economy. Change our legal immigration system to eliminate outrageous non-immigrant and immigrant visa delays and encourage the immigration to the U.S. of the best and the brightest.
Or, two, deport everyone who had the courage to try to make it in America, even without a visa or status. Keep legal immigration restricted and strangle the economy, innovation, and motivation. In the application filed, I received a query stating "Labor Condition Application is marked to indicate you are an exempt HIB dependent for the beneficiary based on the existence of masters degree from the United States. Please confirm your claim that you are an expemt for this beneficiary. If no United States masters degree exists for this beneficiary, the LCA is not valid and may require a withdrawal of the current petition and filing of a new petition with a new LCA that adhers to Labor Department's requirement for H1B dependents".

You need to file a COS from H-4 to H-1B. You cannot work until the H-1B is approved, because you are not in H-1B status now and therefore cannot use H-1B portability rules. You will not be subject to the cap since you have held H-1B status withing the past 6 years, and presumably not used a full 6 years.
Whether your last employer or a new employer files for a new H-1B status for you, it is still a new filing and any prior filings are not relevant, except to show that you are not subject to the cap.
By the way - this might get more comments if posted in the Nonimmigrant Visa section of the forum.

Hello folks. Here is the overiview.
485 EB3 world, applied Augut 8, 2007. ND is Oct 8, 2007.
I just checked today and saw LUDS on my cases. NO lUD on 485 at all. (not approved) No LUD on AP or EAD. (these are approved)
These are all approved as well.

I140 LUD 7/13/2008
I290BLUD 7/13/2008 (I had to file because my H1 extension was denied. It was approved after the appeal. However, the status for this still shows received and we will let you know when we make a decision. this was 2 years ago. I have since then able to extend my h1 again.

My wife was in US in Oct 2007 on H4 Visa and went back in Mar '08 while she was in US we applied her H1B in 2008 and was approved and she got her H1B stamped in India and came back to US in Oct 2008. since she did not find any job, her payroll is not running and the her employer wants her to switch back to H4 Visa, and once she finds a project she can change her status back to H1B.
My Question here is
1) For COS from H1B to H4, Does she need Pay stubs? and how easy it is for the COS?
2) Her Employer says that she can apply for H4 Stamping and inform the Visa Officer that during her stay in US she did not join the company for medical reasons. Does this create any issues with her H1B.
3) Can Some one suggest a good immigration Lawyer in San Diego?

I want to apply for AP but I'm not sure if I qualify and I don't want to get rejected as I cannot afford to lose the money. I am here on F-1 visa and got married and subsequently have applied for I-485 and got receipt for it.
1. Can I apply for advanced parole?
2. I want to go home and visit family and/or have AP in case I need to leave. Is this a valid reason? Is this what I write as my reason on form?

If I transfer my H1-B now to another company, then do I automatically get another 3 years or do I have to file an extension after my H1-B has been transferred?
