    i hv an approved I-140 thru employer A (my current employer). so i am eligible for 3 yrs H-1B extension. the I-140 was approved more than 6 months ago.

    You are only eligible for a 3-year extension (assuming you have less than 3 years left of your initial 6-year stay) if your I-140 is approved AND your priority date is backlogged.

    once my H-1B extn is approved for 3 yrs, i want to xfr my H-1B to employer B. in that case, if employer A revokes the I-140, then what happens to my H-1B extn? does that become null and void?

    No, but you cannot use that I-140 to get another H-1B extension.

    pls. note that I-485 is not filed, so i cannot invoke AC-21.

    You are using AC21 for the 3-year extension, just not the 485 portability section of AC21.

    I was looking through my LC and 140 documents and found out that there are two different job titles in LC. One is Employer Job title which is "Analyst Programmer" other one is prevailing wages occupational title which is "Computer Systems Analyst". My question is what should be my Title at new employer?

    Hello all,

    I had my 140 reinstated in Feb-09 after it was denied back in 08 (filed motion to reopen). Last week i inquired about the status of my case since my visa category is current (VB 02/2003), I received a letter yesterday informing me that the case is out of the processing date, my 140 priority date is 12/2002. is this a mistake or my priority date has change to feb-09?

    Processing Date is different from Priority Date. What is your I-485 Receipt Date?

    Hi All,

    I had a question regarding the relationship between the number h1b transfers and green card process. I've heard some people say that if you have transferred H1b to many companies then the green card process will be delayed because USCIS needs to be convinced that you will be continuing with the same employer. Is this true or does it really not matter how many times you change employers it doesn't effect the green card process.

    I have already transferred once. I am thinking of transferring one or possible two more times but am just worried about how this will effect the green card application process.

    Dates are valid as of November 30, 2008. Texas is processing July 11, 2007 applications. Looks good. It means CIS finally has time to work on the deluge of applications they received in July 2007, even though the dates are not current yet. The approvals may still be far off, but at least we know that our apps are being worked upon.
    They will keep the dates between July 11 to July 30 for a few months. During this period, they have not recieved much applications as most of the companies just kept the papers as USCIS announced that they will not accept the forms and reject. Most of the July fiasco applications must have been filed from August 3. If they are really working, then the dates should move to August 2007 in next month processing time.

    Hello All,

    My wife's AP was sent out on NOV13th according to online status and we didnt receive it till now and I called the USCIS today and the rep we didnt receive it back as undelivereable & once its once out of our office its not their concern & told re-applying is the only option.

    Issue?: My wife went to INDIA and she is on L1 and I was wondering when I re-apply her AP here, can she enter while her AP is pending approval ?
    her L1 is valid till June 2010.

    What are our options, please advise.

    If she has a valid L1 stamping in passport and she is still working for the employer she can enter without problems.

    While working for Company A, I took LC substitute (may 2007 as a future employer) for Compnay B and filed concurrent 140/485 in July 2007 fiasco (India EB3 PD Oct 2004). Later in Feb 08, I've joined Company B with H1 transfer while 140 & 485 were pending (for me and my spouse). I've not filed H4 ext for my wife thru company B as we both had VISA stamping from Company A till 4 Apr 09. I94 also has the same dates.

    My H1 with company B got approved early this month (Took 12+ months after one RFE was answered in Oct 08). New H1 and I94 on Approved 797 has the date till 02 Oct 2010 (6 yrs from the first H1 start date). The I94 card number is not same as my previous I94 card. 140 got approved in Oct 08. I've valid EAD (renewed once) but never used it.

    I'm curently on H1 and my wife is on H4. My wife's EAD is expired and I'm in the process of renewing it. My wife's H4 & I94 is expiring on 4 Apr 09 and I've not filed for H4 extn.

    1. Do I need to file H4 extn? Or will my wife's status changes to AOS when the H4 & I94 expires? Will my status also have to change from H1 to AOS inorder for my wife's status to change to AOS?
    2. If my wife can change to AOS while I'm on H1, can she start using EAD and I continue to be on H1?
    3. If I'm on H1 and loose the job then I'll have to go back to India. But if I change my status to AOS/EAD then I can stay in US waiting for the next job. If I loose the job, can I change to EAD (after losing the job) or should it be done while I've job in hand?
    4. If I switch to EAD and have some issue with 485 processing, can I switch back to H1 (Provided I'm still with the same employer and my H1 is valid)? What happens to my wife's staus in this case?

    What is the last day for filling H1B? (assuming cap of 65,000 is not reached)

    To be specific, can it be filled after 30th sept, 2009?

    I am assuming you are talking about a new H1 that is subject to the 2009 - 2010 cap of 65K. You can file it anytime as long as H1 numbers are available. You can even file for a H1 in Sept. 2010 (that is subject to the 2009 - 2010 cap) if a visa number is available from the 2009 - 2010 quota (not sure if your job has to start before Oct. 2010 to qualify for a H1 subject to the 2009 - 2010 cap though).

    If you are born in UK and if you apply for labor certification under EB-2 category (job requirement: Master's degree or BS+5 yrs exp) then your priority dates are current and you can file for I-485 and get your GC in about 1.5 yrs...(ofcourse only if its not stuck under name check or any other complications...)

    your wife should be fine and within status even you changed the job.
    I asked this same question to my lawyer in 2006. we got that its valid.
    You might drop few lines to your company's attorney to find out exact answer.

    I strongly suggest that you do not go for visa stamping (unless there is a family emergency) if you get the new H1B approved. I went for the visa renewal and after nearly 7 months I am still waiting. I am not from any restricted country or have any thing problematic in my name (if you know what I mean). Since these investigations are confidential, I may never know the reason for my situation. From the various forums on this subject, i have gathered that, once you get flagged, you are condemned for life or until you get citizenship. Even if you have done nothing wrong...they like to test your patience again and unfortunately the pleasure is all theirs.

    If you have to get stamped, get it from a neutral country such as Canada. A company that can allow you to work from overseas while you are waiting for the visa will help a lot. Also ask your friends to help you with your apartment and other belongings if it takes too long to get the visa. If you do get the visa quickly then just thank your lucky stars for they were more powerful than the VO on that day and time.

    I have a question about the Aytes memo - it says that if the name check has been pending for more than 180 days, then the 485 will be adjudicated. My question is when does the 180 day clock start? Is it on the day that the 485 application was received by the service center (going by the receipt date on the 485 notice)? Or is it the day when your PD and processing dates both become current?

    Neither I think( i might be wrong though ). I think the 180 days is from the day USCIS submits your case to name check.

    What I wanted to transmit with this pic, apart from the beautiful light, was the inmensity of the sky...I showed so much sky partly to convey that feeling...but I scrolled the image up to see how it looked cropped, and it looks more balanced.....I have to think about this one
