    Option 1: you can get someone to take your photograph with a digital camera and then use Passport photos for free - ePassportPhoto.com (http://www.epassportphoto.com) to make sure that it is cropped to size and meets the size requirements. You will need to ensure that the picture is taken correctly though (without shadows, against a plain light background, etc.). You can get more details about the photo requirements from:
    Guidelines for Producing High Quality Photographs for U.S. Travel Documents (http://travel.state.gov/passport/guide/guide_2081.html)

    Option 2: You can also go to any place like Costco or Walgreens and have them take your picture and upload the scanned version of the picture.

    I used Option 1 and it worked just fine.

    People who get labor approved in August, can they avail current window provided by USCIS and concurrently file 140/485?

    Same thing happened with me - My labor was approved from Phily BEC on Mar 16th 07 and my company kept saying that didn't receive anything till Apr 16th 07...

    Then i was impatient and called Phily BEC and they were very nice to explain me that it can take upto 1.5 months to 2 months for my company to receive via Lawyer. In fact it may take 1 month for Phily BEC to mail - he explained.

    Eventually my company received the Labor papers on May 7th 07....

    Hi All,
    My Employer applied for Labor on Aug 11th 2010 and yesterday we got the audit notice saying :

    The application indicates the foreign worker is required to live on employer's premises although the application does not indicate the position is for a Live-in domestic. Please provide a detailed explanation indicating the reason the foreign worker must reside with the employer.

    In ETA-9089 for Section H-17 question we have checked "Yes" but i guess it should be No.
    We miss understood the question and thought it was asking about working at location and maked it yes.

    my question is :
    1) Can we make correction and send while replying to Audit (RFE)?



    Please help on this.

    Hello,

    Contact a good attorney asap. Your details would most probably raise anyone's eyebrows at USCIS/DOS/ICE. Also, a lot depends on exact dates when you entered/left US and when your different applications were rcvd by respective govt egencies as these details will help you to establish that you are not in violation of any US laws.     Right - You will have to wait to apply for 485. You can do so only once your Priority DAte is current on the VISA Bulletin.

    You can file for i-140 though.......I guess you have a long wait to file 485 and EAD/AP

    Keeping H1 also has some advantages.

    Sorry cant help you on the documentation piece.

    But since your I-140 is filed, you should upgrade it to PREMIUM and try to get it approved asap.

    Worst case scenario - if company B is not considered successor in interest to company A, you can still use the approved I-140 to carry over your PD.

    Has anyone tried extending NJ DL using H1b extension receipt ?

    My H1b extension is in VSC and looks like it will take long long time to come back....DL is expiring in 30 days, with EAD my renewal would be for 6 months only as EAD also expires in Aug.

    wonder if they will accept H1b receipt with employer letter ?

    please share your NJ DL experience.

    I had extended our licenses from wayne DMV this past march - but I had H1 and H4 approval notices. They did ask me for our approval notices specifically. We also handed our H1/H4 receipts, but she handed those back to us. I would think that they will need the approval notices just to figure out the validity of the new license they will issue.

    I guess you can show them your EAD document and try to get a renewal for couple of months, I am not sure though.

    I am considering switching my employer.

    Currently I have I-140 and labor for GC approved in 2006.
    Filed I-485 in July 2007.

    My current H-1B expires on December 2009. (9 years on H-1B.... ya that long)

    Based on my AC-21 portability after 180 days of I-140 approval, if I move to a new employer and file H-1B transfer, will I get default approval of only upto December 2009, or can I get 3-year extension based on my I-140 approval?

    Appreciate your answers in advance.

    You can get 3 years extension based on your approved I140. Please consult a lawyer before jumping into conclusions though.

    Howdy,

    You cannot file for EAD or AP unless your get your I-485 receipt (A copy of the receipt notice needs to be included in the EAD and AP application). The EAD and AP should go to the same service center as your I-485 application. The address will be listed on your I-485 receipt notice. Pretty straight forward, you can do it yourself, do not pay a lawyer for preparing these documents. Good luck.

    Hi All,

    First of all Congrats! to all people who are eligible to file 485 in july..

    i have strage problem..i am not weather its a problem or not..i have filed my GC in 2004 December and you all know that after that the BEC process came in every thing went to BEC's..and i had no hope on that file and i asked my employer to process my GC under PERM process in 2006 april and i got the Labor and I-140 approved in 6 months...and mean while i got the 2004 labor approved in Feb 2007 and asked my employer which one will be the best and he recommended me apply for I-140 for 2004 labor and wait untill the dates become current and he was expecting the 2004 will become current...so we have applied for I-140 for 2004 labor on May 1st 2007 and the status is pending...now my questios is..

    1) Is there is any problem if i use the 2004 labor and apply for I-485.

    2) When attorney file for I-140 did they mention any where in that forms that i do not have any immigration petiton has been submited before?

    3) If they mention no (miss communication) and applied for I-140 for 2004 labor but in fact there is a petition (I-140) submited for me for my 2006 labor.will this be a problem for my 485 approval?

    4) which one will be the best for me to use now 2004 or 2006?

    5) I spoke to my attorney on this and he said as long as you have not filed for 485 for 2006 labor then there is no harm.But i am concernet about that if my attorney (2004 labor) mentioned that i have not submited any immigartion petition when he filed for I-140,which is not correct since i have appled for I-140 for 2006 labor will that be a problem for my I-485 process?

    They will take your I-94 at the airport in washington where you will board your flight....

    In my experience my previous I-94 was issued to me on AP for one year when I had come in......they did not bother with the I-94 on my H1B.


    Anyways since yours is an international flight the agent at the counter will take care of whichever they want.....just present them with both. Mostly they do not bother with the one in I-797 notice.

    Just a side note,you should send EAD/AP renewal applications only 120 days in advance not 180 days..according to the new rule set by USCIS.
