My husband and I filed our documents last July 5. It reached USCIS on July 6. I was also confused whether to file or not but I said to myself that even if we don't win the lawsuit at least we tried. I know we all don't know the outcome of this whole fiasco but the only thing we can do is hope and pray for the best. My brother is also H1 and just waiting to adjust status like me and my husband but he hasn't filed his documents. I can't tell him what to do because it's his own decision. I do know that I feel good about our decision and no matter what the outcome is, I'm glad that my husband and I did file our documents. So come Monday, I'll be keeping my fingers crossed and praying for all of us. :)

That is exactly what the senate has been doing. And the House too.
Naming post offices, designating and recognizing festivals, naming courthouses and writing checks to run the government.
1. Immigration Reform: cant do.
2. Ending the war : cant do.
3. Reducing healthcare costs, reforming healthcare: cant do.
4. Upcoming social security deficit : cant do.
5. Budget deficits reduction : cant do.

1. Pass a resolution stating that it is the sense of the senate that sky is usually blue in color but on cloudier days, it tends to be green.
2. Pass a resolution that water is wet and fire is hot.
3. Pass a resolution that the building of Capitol is White is color, December is the last month of the year and the White House is also white in color.
4. Take a break, eat peanut-butter and jelly sandwich, play in swings outside the senate building and then take a little afternoon nap. A little fight between Democrats and Republicans on getting equal time on swings and equal time with possession of soccer ball and baseball bat.
5. Afternoon post-nap, easy-going session, name a few more post offices, praise the troops, criticize the war, praise the troops again, criticize the war again.

Basic purpose of our forum is to create awareness/educate legal Immigrants so that they can get help for there cause at the same time we get some help from them to push forward this movement. Recently we are seeing big inflow of queries because economy is bad our brother and sisters getting in deep trouble.
How we can voice our concern in this bad time key is to find the solution.
My thoughts on this................
1) Get the help from our Indian/Chinese community on all levels like city, state and national level.
2) We will run advertisement campaign about, who we are and where we stand. This adv. could be air on Lue's show or even on other popular shows...
3) We need lobbying in congress .I know we have this in this place but we can show our strength through legal Indian/Chinese Immigrant plus Indian/Chinese American citizen then we got big weight in our plate.
4) To get all of the above and may be more we need Money and Man power to execute this.

You said your employer is agreable, in that case, If you did not get your EAD before your current EAD expires, you can choose to work for free for those days and try to get paid for it after your EAD comes in effect.
Or even if you don't get paid for it, you are building some good will and you are not jeopardizing your job. It will definitely keep you in the good books of this employer.

I am planning to change my apartment next week. Its same city same zip code just different apartment complex (got a better deal). I am working the same job, same profile no changes since filing my 485 in Aug 2007. I also received a RFE in July 2008 (at that time my PD was current) it was for BC for which I had submitted an affidavit from my parents since the original was in local language. For the RFE I did an notarized translation of the doc and submitted it. They had also asked for updated EVL with supporting paystubs W2. I sent that and the application has been pending since.
The question I have is will this address change trigger another RFE?. Does any one have any such experience?
I changed my address twice recently in a short period of time. Same state but different zip codes. I did not get any RFE's. I already got an RFE in Oct 2008 before I moved. There were Soft LUDs on my applications both the times but no RFEs. I dont think change of address will trigger RFEs.

Congratulations HBK, what a relief to hear the good news on your case, I am in the same situation and started collecting papers to apply on normal processing will update all of you how it goes. same Vermont ..I am applying.
Hope things will work out good. the disaappearence of H1B memo from USCIS policy website itself is a good sign, let them announce formally also that they have withdrawn that memo.

Guys, I was just laid off and have efiled i539 3 days after the termination date for a status change to F2. Now working on the application letter. Do you think I should mention the layoff in the letter?
If I do mention it:
Con: The layoff might quickly catch the eyes of the immigration officer and if he want to check my status, he could find out the 3 days OOS.
Pro: My previous job was well paid. By mentioning it, I give the reason that why I want to stay at home as F2 instead of keeping the well paid job.
I guess I will mention it in the letter to explain the whole situation and hope everything will be all right. Let me know if anybody disagrees asap, I will mail out the stuff with in next two days.

I think since in their case there is not Labor Certification process so their PD is the day they file I-140.
Internet - In either case, it helps EB3 for the next yr as these 61,000 nurses are removed from EB3 quota.
Also I am wondering whether nurses also have PD or something like that. If most of them have PD > 2006 then they will not be able to use EB3 visas as it is retrogressed and stuck at 2001/2002.

It is certainly possible to continue the green card process in your situation. The key requirement is that once your PD becomes current you MUST have a full time permanent job offer in the US, which you intend to accept.
If you abandon your I-485 and pursue consular processing, that position MUST be in the same position and with the same employer that obtained your labor certification. AC-21 DOES NOT APPLY TO CONSULAR PROCESSING. If you maintain either your A/P validity or H-1 visa validity, as long as the position is in the "same or similar occupation", it can be with any US employer.
Keep in mind that even if your family ends up abandoning their I-485's, as long as you do not abandon your I-485 they will be able to "follow to join" you once your AOS is granted.
Also keep in mind the possibility of EB-1 eligibility if your position with the new company can be characterized as managerial or executive and you are able to secure a transfer back to the US in a managerial or executive position after working in India for at least one year.

1)would there be any problem during the Visa stamping?
2)What should i do to other visa ,which i will be not using?
3)How should i approach the employer whose employment i will be not accepting?
4)I have signed one offer letter from the employer but other employer had not provided me with the offer leter.so whom should i join?

If you open a company on EAD, you are eligible for any positions that pay by W2 right?
If you have an EAD, you can take up any job which pays by W2... Opening a company has nothing to do with it.
If you are opening a company and you do Corp to Corp with any other vendor or Consultancy, then they will pay your corporation...and you get paid. From your side that is business income and you can deduct your expenses.

we have been traditionally fearful and resistant to stepping out of the shadows. the question is - after a successful campaign that helped bring USCIS to it's knees, has something fundamental changed in enough of us?

There is no doubt that their work is a lot harder than it appears, but the point is that H1B is always interpreted as Visa for Computer Programmers ONLY, in the mainstream media. I think its time to publicize this new initiative from congress and let everyone know that H1B is not only for Programmers, it’s also for Fashion Models, Doctors, Engineers, Architects, Scientists and who knows what else! :mad:

Are they issuing EADs to 2 year olds? That would mean it is legal for a 2 year old to work which just does not add up.
My co-worker, who has 5 year old kid, his son received an EAD (he filed I-765). He applied for SSN and received the SSN card within 5 days of application.
If Sury wants SSN for his kid, s/he can give a try.

I was on L1 since Dec 2001 and left in Aug 2005. Came back on H1 in March 2006; H1 was approved only till Dec 2007 ( 6 yrs from 2001). I did not get a fresh 6 yrs., when I moved from L1 to H1. I believe this is the same case with H4.
The reason why I am asking is that I saw a Immi. Attorney reply in one of the Silicon valley magazines that L1 is not counted against H1 6 yrs. clock. From my H1 approval I find this to be incorrect interpretation.
Can anyone share their experience on this.
